General Terms and Conditions
for the online shop of Handmade by Matima – proprietor Saskia Taheri
Last updated: September 2026
1. Scope
These General Terms and Conditions apply to all orders placed by consumers (Section 13 of the German Civil Code, BGB) through the online shop of Handmade by Matima or by email following an enquiry.
A consumer is any natural person who enters into a legal transaction for purposes predominantly unrelated to their trade, business or profession.
2. Contracting Party
The purchase contract is concluded with:
Handmade by Matima
Proprietor: Saskia Taheri
Am Mühlenfließ 39
15234 Frankfurt (Oder)
Germany
Email: saskia.taheri@web.de
VAT identification number: DE436851189
3. Subject of the Contract
The contract concerns the sale of individually designed and personalised products.
Because the products are individually handmade, slight variations in colour, material, texture or arrangement may occur. Such variations are possible provided they do not impair the agreed characteristics or normal use of the product.
4. Formation of the Contract
The presentation of products in the online shop is not a legally binding offer, but a non-binding invitation to place an order.
By submitting your order, you make a binding offer to enter into a purchase contract. The contract is concluded when I accept your order by sending an order acceptance email or dispatching the goods ordered. An automatic acknowledgement of receipt of your order does not, by itself, constitute acceptance.
For orders by email following an enquiry, I will send you an individual offer including the product description, total price, shipping costs, payment terms and delivery time, together with these Terms and Conditions. The contract is concluded when you accept this offer by email within the acceptance period stated in it.
If, exceptionally, a product is unavailable, I will inform you promptly.
5. Prices
All prices are stated in euros (€).
Prices include statutory VAT.
Any additional shipping costs are shown separately during the ordering process.
6. Payment Methods
The following payment methods are available:
-
PayPal
-
Klarna
-
Apple Pay
-
Google Pay
-
Bank transfer (payment in advance)
Your payment method will be charged in accordance with the terms of the relevant payment service provider.
7. Delivery
We deliver to Germany, Austria, Switzerland, Norway and Luxembourg.
Delivery to other countries worldwide is available on request. Please contact me before placing your order at saskia.taheri@web.de and let me know which product you would like and the destination country. I will check whether delivery to your address is possible and include the shipping costs and delivery time in your individual offer. Delivery to other countries requires a separate agreement.
Production usually takes 2–4 weeks from receipt of payment and, where required for production, receipt of your clothing at Handmade by Matima. If both are required, the production period starts once both payment and clothing have been received.
Shipping time to the destination country is additional to production time. The delivery period applicable to your order will be stated in the online shop or individual offer before you place your binding order.
If delays occur after the contract has been concluded, I will inform you promptly. This does not automatically extend an agreed delivery deadline. Your statutory rights in the event of delayed delivery remain unaffected.
8. Shipping Costs
The following shipping charges apply to ordered goods:
-
Germany: free of charge.
-
Austria: flat rate of €25.00.
-
Switzerland: flat rate of €29.00.
-
Norway: flat rate of €40.00.
-
Luxembourg: flat rate of €25.00.
For delivery to other countries worldwide, shipping costs are calculated individually according to the destination and shipment size.
Deliveries to countries outside the European Union, particularly Switzerland and Norway, may incur additional import charges, such as import VAT, customs duties and carrier clearance fees. You are responsible for these charges unless they are expressly included in the stated total price or otherwise agreed in the individual offer. They may be collected by the relevant authorities or the carrier.
9. Retention of Title
The goods supplied remain my property until paid for in full.
10. Statutory Warranty
Statutory warranty rights apply.
11. Liability
I am liable without limitation for damage caused by intentional or grossly negligent breaches of duty, and for injury to life, body or health.
In the event of a slightly negligent breach of essential contractual obligations, my liability is limited to foreseeable damage typical of the contract.
In all other cases, liability is excluded to the extent permitted by law.
The provisions of the German Product Liability Act remain unaffected.
12. Right of Withdrawal
Consumers generally have a statutory right of withdrawal.
However, the right of withdrawal does not apply to contracts for goods that are not prefabricated and whose manufacture is determined by your individual choices or specifications, or which are clearly tailored to your personal needs (Section 312g(2), point 1, BGB).
This applies in particular to keepsakes made to your individual specifications and personalised products.
For further information, please see the separate Withdrawal Information.
13. Damage in Transit
Please check the goods for obvious transport damage immediately on receipt.
If transport damage is visible, please report it to the delivery person as soon as possible and inform me promptly.
Failing to report damage or contact me does not affect your statutory warranty rights. Reporting it does, however, help me pursue my claims against the carrier.
14. Data Protection
Information about the processing of personal data is provided in my separate Privacy Policy.
15. Applicable Law
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.
Mandatory consumer protection provisions of the country in which you habitually reside remain unaffected.
16. Contract Language
The language of the contract is German.
17. Final Provisions
If any provision of these General Terms and Conditions is or becomes wholly or partly invalid, the remainder of the contract remains effective. Statutory provisions apply in place of any invalid provision.
